  1. Purpose and Scope

These General Terms and Conditions of Sale (GTCS) define the rights and obligations applicable to any order placed with DMguitars, whether through the website www.dmguitars.eu or via any other channel (email, social media, telephone).

They apply to sales concluded with both consumers (B2C) and professionals (B2B), unless otherwise agreed.

If a purchase is made for personal use but the actual use of the product proves to be professional (lessons, concerts, recordings, etc.), the contractual relationship may be reclassified as a sale between professionals (B2B), thus excluding the right of withdrawal and consumer-specific protections.

  1. Products and Availability

DMguitars offers for sale acoustic and electric guitars (new or used), as well as accessories and spare parts, also available new or used.

Used products may show signs of wear or prior modifications. Older or vintage instruments may also display features linked to their age. The customer is informed of these elements at the time of purchase.

Product descriptions and photos (on the website or sent by DMguitars) are prepared with care. However, minor differences may exist between the images and the actual product received, particularly in color, finish, or aesthetic details — especially on used items.

If a product becomes unavailable after payment, the customer may choose between:

  • A full refund within 7 working days;
  • A store credit valid for 12 months;
  • An equivalent product, subject to prior agreement.
  1. Pricing and Payment

Prices are expressed in euros (€), including all applicable taxes (TTC).

VAT not applicable under Article 293 B of the French Tax Code (micro-entreprise status), unless thresholds are exceeded or in case of intra-EU delivery under the OSS scheme.

Accepted payment methods:

  • Bank transfer
  • Cash (only upon in-person collection, within the legal limits established by French and European regulations)

Customs duties and local taxes outside France are the responsibility of the customer. All transactions are secured using SSL encryption. DMguitars does not store any banking data.

  1. Order and Confirmation

Any order is validated upon confirmation of payment. DMguitars reserves the right to cancel an order in case of non-payment, suspected fraud, or obvious pricing error.

  1. Delivery and Shipping

Delivery is available within France and Europe via La Poste, UPS, DHL, etc.

Shipping fees and estimated delivery times are provided before order confirmation.

Responsibility transfers:

  • Upon delivery if the carrier is chosen by DMguitars,
  • Upon handover to the carrier if selected by the customer.

In case of a damaged or incomplete parcel, the customer must:

  • Refuse delivery or issue a written reservation with the carrier,
  • Notify DMguitars within 48 hours.
  1. Right of Withdrawal (B2C Only)

In accordance with Articles L221-18 et seq. of the French Consumer Code, consumer clients have 14 days from receipt to exercise their right of withdrawal without justification.

Return conditions:

  • Product unused, in original condition, with all accessories;
  • Return shipping costs borne by the customer (unless the product is defective);
  • Refund issued within 14 days of receipt of the return (Article L221-24).

Exceptions (Article L221-28):
Customized or modified products at the customer’s request are non-refundable.

  1. Warranties

Legal Warranty of Conformity (Articles L217-3 et seq. of the French Consumer Code):

In accordance with applicable legislation, products are covered by the legal warranty of conformity:

  • 2 years for new products,
  • 1 year for used products.

This warranty covers defects that render the product unfit for normal use or inconsistent with its description at the time of purchase.

Used Products:

Used products may show signs of wear or aesthetic alterations due to prior use, such as scratches, patina, replaced parts, or adjustments. If such elements are visible or described, they do not constitute a defect of conformity.

The customer is deemed to have been informed of the product’s condition at the time of sale. Any known detail or modification is mentioned in the product sheet or in prior communications.

Warranty exclusions:

The warranty does not cover:

  • Normal wear related to the product’s age and use;
  • Aesthetic flaws described or visible at the time of sale;
  • Damage caused by improper use (impact, humidity, exposure to extreme temperatures, mishandling);
  • Damage resulting from inadequate storage or lack of appropriate maintenance;
  • Any intervention or modification without DMguitars’ prior approval.

  1. Personal Data (GDPR)

Personal data is collected for order processing, customer support, and the sending of marketing communications (with prior consent).

Personal data is retained for a period consistent with legal obligations and proportionate to the purpose of collection. In accordance with Articles 15 to 22 of the GDPR, each customer may request access, correction, or deletion of their data.

  1. Sales to Professionals (B2B)

Professionals acknowledge that legal warranties and the right of withdrawal do not apply, unless otherwise contractually agreed. B2B sales are governed by general contract law.

This clause also applies to clients whose product use is reclassified as professional.

  1. Dispute Mediation (Consumers Only)

In accordance with the French Consumer Code provisions on amicable dispute resolution, this section applies only to consumer clients (individuals not acting in a professional capacity).

In case of an unresolved dispute with DMguitars, the consumer may use the mediation service to which DMguitars adheres:

Before contacting the mediator, the customer must send a written complaint to the registered office of DMguitars. If no amicable resolution is reached within a reasonable timeframe, the customer may then submit the case to the mediator, following the procedures outlined on the CM2C website.

  1. Applicable Law and Jurisdiction

These GTCS are governed by French law. In the event of an unresolved dispute, the competent court shall be that of the consumer’s place of residence (Article R631-3 of the French Consumer Code).

  1. Force Majeure

DMguitars shall not be held liable in case of unforeseen events such as strikes, pandemics, natural disasters, cyberattacks, etc.

These GTCS are subject to change. The applicable version is the one in effect on the order date. Placing an order implies full acceptance of these terms.
